Tudor Gold Corp. filed a Notice of Abandonment of Appeal with the Supreme Court of British Columbia on March 19 2026, formally dropping its challenge to the Chief Gold Commissioner’s May 28 decision on the Mitchell Treaty Tunnels (MTT). The appeal, lodged on July 14 2025, had sought to invalidate the conditional mineral reserve that protects the tunnels from interference by Tudor’s mineral claims. By abandoning the appeal, Tudor accepts that the MTT authorizations do not grant Seabridge any interest in Tudor’s claims.
The MTT are a critical component of Seabridge’s KSM project, consisting of two parallel tunnels that link the east and west sides of the mine site. Approximately 12.5 kilometers of the tunnels cross Tudor’s mineral claims, and the conditional mineral reserve requires holders of those claims to refrain from obstructing the tunnels’ construction, operation, or maintenance. Removing the legal hurdle eliminates a major source of uncertainty that could have delayed permitting and partnership negotiations for the KSM project.
Seabridge’s KSM project is one of the world’s largest undeveloped gold and copper projects, with proven and probable reserves of 47.3 million ounces of gold and 7.3 billion pounds of copper. The removal of Tudor’s appeal clears a key de‑risking step, enabling Seabridge to advance de‑risking activities and pursue a major mining partner. The company’s ability to secure a joint venture or equity investment hinges on resolving regulatory uncertainties such as this, and the abandonment of the appeal is a positive signal to potential partners.
